These Terms of Service (the “Terms”) govern your access to and use of the website primeultrasound.com and the application app.primeultrasound.com (together, the “Service”), operated by Prime Ultrasound (“we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms.
You must be at least 18 years old and authorized to submit billing information for the cases you record. By using the Service you represent that you meet these requirements.
You are responsible for keeping your login credentials secure. You agree to notify us immediately through the app if you suspect any unauthorized use of your account. We are not liable for losses caused by stolen or shared credentials.

The Service is currently free for individual sonographers. If we introduce paid plans in the future, we will update these Terms and notify account holders in advance. Paid plans, if offered, would renew automatically each billing period until cancelled.
If paid plans are offered in the future, refund terms will be stated at checkout and in an updated version of these Terms.
If we introduce or change paid plans, we will provide at least 30 days’ notice before new prices apply to an existing subscription.
You retain ownership of all case data you enter. You grant us a limited license to host, transmit, and process that data solely to provide the Service. See our Privacy Policy for details.
We work hard to keep the Service available 24/7, but we do not guarantee uninterrupted access. We may perform maintenance, deploy updates, or experience outages. We will give reasonable notice of planned downtime when we can.
Prime Ultrasound surfaces Medicare reimbursement rates from publicly available CMS data sources. We update these regularly, but rates change frequently and depend on locality, modifiers, and policy changes. You are responsible for verifying rates with your billing team or payer before submitting claims. We make no warranty that any displayed rate is current or correct for your specific claim.
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the fullest extent permitted by law, Prime Ultrasound and its founders, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, lost profits, or lost data arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD $100.
You agree to defend and indemnify Prime Ultrasound against any claim arising from your misuse of the Service, your violation of these Terms, or any billing data you submit.
You may cancel your account at any time. We may suspend or terminate your account if you breach these Terms or use the Service in a way that risks harm to other users, our infrastructure, or applicable law. Sections 5–10 and 12–13 survive termination.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state and federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. Material changes will be announced in-app and by email at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
